Privacy Policy

ASMC Servicing, Ltd. ("ASMC," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have. It applies to the ASMC Contract Portal at portal.asmcservicing.com (the "Portal"), to the documents and communications we deliver through it, and to our websites and other interactions with applicants, dealers, and lenders.
1. Who This Policy Covers
We collect information about three groups of people:
- Applicants – consumers who apply for financing for home improvement work, and any co-applicants or property owners who sign related documents.
- Dealer and contractor personnel – people who submit and manage applications on behalf of a dealer.
- Lender personnel – people who review, approve, fund, and service contracts.
Much of the information we hold about applicants is provided to us by the dealer that submitted the application, not by the applicant directly.
2. Information We Collect
Identity and contact information
Name, mailing and property address, city, state, ZIP code, email address, telephone number, date of birth, Social Security number, and the relationship of a co-applicant or property owner to the applicant.
Financial information
Bank account and routing information, bank account balances and transaction history obtained through Plaid, income and employment information, consumer credit reports and credit scores obtained from consumer reporting agencies, contract amount, rate, term and payment amount, payment history, and payoff and account status information.
Contract and document information
The contents of the credit application, contract documents, completion certificates, owner consent forms, income confirmations, supporting documents and photographs uploaded to a contract, notes and messages exchanged about a contract, and records of calls or interviews conducted about an application.
Electronic signature records
When a document is signed electronically we record the identity of the signer, the document and the place within it that was signed or initialed, and the date and time of signing. We retain these records as evidence that the document was executed.
Account and usage information
For Portal users, the email address and name associated with the Google or Microsoft account used to sign in, and the organizations that account is authorized for. For all visitors, IP address, browser type and version, device identifiers, pages visited, time spent on pages, and date and time stamps. We also collect diagnostic and error information when something goes wrong.
Cookies
We use strictly necessary cookies to keep you signed in, to maintain your session, to detect your time zone so that dates and times display correctly, and to protect against cross-site request forgery. We do not use advertising cookies, and we do not run third-party analytics or tracking scripts on the Portal.
3. How We Collect Information
- directly from you, when you fill in an application, sign a document, upload a file, send a message, or contact us;
- from the dealer or contractor that submitted an application about you;
- from Plaid, when you connect a bank account;
- from consumer reporting agencies and other verification services, when we obtain a credit report or verify information you provided;
- from your device automatically, as described above;
- from Google or Microsoft, when you sign in to the Portal — we receive your name, email address, and profile image, and we do not receive or store your password.
4. How We Use Information
- to evaluate a credit application and make a credit decision;
- to verify identity, income, employment, bank account ownership, and completion of the financed work;
- to prepare, deliver, and electronically execute contract documents;
- to fund, service, bill, and collect on a contract, including processing ACH payments;
- to communicate with applicants, dealers, and lenders about an application or contract, including by email and, where an applicant has opted in, by text message;
- to detect, investigate, and prevent fraud, and to protect the security of the Portal;
- to operate, maintain, debug, and improve the Portal;
- to comply with applicable law, respond to lawful requests, and enforce our agreements.
We use an automated service provided by Anthropic to help read and summarize consumer credit reports for lender review. Credit decisions are made by ASMC and its lending partners, not by that service.
5. Text Messages and Mobile Information
Where an applicant opts in, we send text messages solely to coordinate a time to speak about an application. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time. Consent to receive text messages is not a condition of any purchase or of obtaining credit.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties, except with the service providers that transmit the messages on our behalf.
6. How We Share Information
We do not sell personal information. We share it only as follows:
- Service providers. Companies that perform services for us and are permitted to use the information only for that purpose, including Plaid (bank account linking and verification), Google and Microsoft (sign-in), IntelliPay (ACH payment processing), our email and text message delivery providers, our hosting provider, and Rollbar (error monitoring).
- Dealers and contractors. The dealer that submitted an application can see the status of that application and the documents associated with it.
- Lenders, assignees, and investors. We share application and contract information with lending partners evaluating an application, and with parties to whom a contract is assigned, sold, or pledged, and their advisors and auditors.
- Consumer reporting agencies. We may furnish information about the performance of a contract to consumer reporting agencies.
- Legal and safety. When required by law, subpoena, or regulator, or when we believe disclosure is necessary to protect our rights, prevent fraud, or protect the safety of any person.
- Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
7. Plaid
If you connect a bank account, you are directed to Plaid Inc. Plaid collects your bank login credentials directly — we never see or store them — and returns to us your account and routing numbers, account balances, account owner details, and transaction history. Plaid's handling of your information is governed by Plaid's End User Privacy Policy. You may disconnect a linked account at any time by contacting us, though doing so may affect our ability to process payments on your contract.
8. Financial Privacy (Gramm-Leach-Bliley Act)
Because we provide consumer financing, the nonpublic personal information we collect about applicants is protected under the federal Gramm-Leach-Bliley Act. The categories of nonpublic personal information we collect include information from applications (such as name, address, Social Security number, and income), information about transactions with us (such as account balances, payment history, and contract terms), and information from consumer reporting agencies (such as credit history and scores).
We disclose that information only to the parties described in Section 6 above, and only as permitted by law. We do not disclose nonpublic personal information about applicants to nonaffiliated third parties for their own marketing purposes.
We maintain physical, electronic, and procedural safeguards designed to protect nonpublic personal information, and we restrict access to employees and service providers who need it to provide services to you.
9. Your California Privacy Rights
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you certain rights. Note that personal information collected, processed, or disclosed subject to the Gramm-Leach-Bliley Act — which covers most of the information we hold about financing applicants — is exempt from these rights. For information that is not exempt, you may:
- request to know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties we disclosed it to;
- request that we delete personal information we collected from you;
- request that we correct inaccurate personal information;
- request that we limit the use of sensitive personal information.
We do not sell personal information, and we do not share personal information for cross-context behavioral advertising. We will not discriminate against you for exercising any of these rights.
To submit a request, email contact@ASMCServicing.com with "Privacy Request" in the subject line. We will verify your identity before responding, typically by confirming information already in our records. An authorized agent may submit a request on your behalf with written permission.
10. Retention
We retain application and contract records, including signed documents and electronic signature records, for as long as the contract is outstanding and afterwards for the period required by applicable law, our records retention obligations, and the needs of any audit, dispute, or investigation. Usage and diagnostic data is generally retained for a shorter period, except where we need it longer to investigate a security incident or improve the reliability of the Portal.
11. Security
We protect information in transit and at rest, restrict access to authorized personnel, authenticate Portal users through their organization's Google or Microsoft account, and monitor for errors and suspicious activity. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If you believe your information has been compromised, contact us immediately at contact@ASMCServicing.com.
12. Children's Privacy
The Portal is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us with personal information, contact us and we will delete it.
13. Where We Process Information
We operate in the United States, and information we collect is stored and processed in the United States. If you access the Portal from outside the United States, you understand that your information will be transferred to and processed here, where privacy laws may differ from those in your location.
14. Links to Other Sites
The Portal may link to sites we do not operate. We are not responsible for the privacy practices of those sites, and we encourage you to read their privacy policies.
15. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and post the new version at this address. Material changes will be communicated to affected users. Please review this page periodically.
